Water Rights & IRS 1031 Exchanges

Did you know that generally speaking water and mineral rights can be exchanged in an IRS section 1031 tax deferred exchange?

Since most of the time water and mineral rights are conveyed by deed they are recognized by the federal government as an equitable interest in real estate and thus considered Like-Kind property in a exchange!

There are a couple of exceptions, but for the most part there is no problem including them in a IRS  - section 1031 tax deferred exchange.
